Renting out a parking space in Munich: what is allowed?
An empty parking space rents out well. What matters is whether you are entitled to dispose of it.
A space you own
If the space belongs to you, you may generally rent it out. In a homeowners' association the declaration of division, the community rules or resolutions may contain rules, for example about access or gates. It is worth reading those documents before your first listing.
A space you rent
If you rent the space yourself, you need your landlord's permission to sublet it (section 540 German Civil Code). Get it in writing. Sostivo provides a template while you list the space. Even with permission you are liable to your landlord for damage the driver causes (section 540(2) German Civil Code).
Space from a building permit
Some spaces are fixed in the building permit as required parking for a particular building. You may rent such a space to residents or users of the same building, because it then still serves the building. To outsiders only if the authority has permitted it. Sostivo asks about this when you list; for spaces reserved for residents the tenant confirms before booking that they live or work in the building. If in doubt, ask your property management or the local building authority (Lokalbaukommission).
What is not allowed
The space is for parking. Storage, living there and hazardous substances are excluded, and so is subletting by the driver.
