Part A, brokerage by Sostivo

Right of withdrawal

You have the right to withdraw from the contract for the brokerage service provided by Sostivo within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract was concluded.

To exercise your right of withdrawal, you must inform us (Muhlis Karaca, Oberföhringer Straße 246a, 81925 München, info@sostivo.de) by means of a clear statement, for example a letter or an email, of your decision to withdraw from this contract. You may use the model withdrawal form below, but you are not obliged to. You can also exercise your right of withdrawal online at https://sostivo.de/en/withdraw. If you use this online function, we will send you a confirmation of receipt on a durable medium (e.g. by email) without undue delay, with information on the content of the declaration of withdrawal and the date and time it was received.

To meet the withdrawal deadline, it is enough that you send your notice of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we must repay all payments we have received from you without undue delay and at the latest within fourteen days of the day on which we received your notice of withdrawal. For that repayment we use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. You will not be charged any fees for this repayment.

If you asked for the brokerage to begin during the withdrawal period, you must pay us a reasonable amount corresponding to the share of the brokerage already provided up to the moment you informed us of your withdrawal, compared with the total scope of the brokerage provided for in the contract.

When your right of withdrawal ends early

Your right of withdrawal for the brokerage ends once it has been fully performed, provided that you expressly agreed beforehand that we may begin before the withdrawal period expires and that you acknowledged that your right of withdrawal ends once the contract has been fully performed (section 356(5) no. 2 German Civil Code). You give that consent and that acknowledgement in the contract step "Widerrufsbelehrung" before you agree to the contract. The brokerage is fully performed as soon as the rental agreement between you and the other side has been concluded and is available to you as a PDF.

Part B, the rental agreement for the parking space

For the rental agreement itself, what matters is who is renting out the space.

If a private individual rents it out, there is no statutory right of withdrawal. The special rules for consumer contracts only apply if there is a trader on the other side. Whether the other side offers the space privately or commercially is stated in every listing, exactly as they declared it to us.

If a trader rents it out, you have fourteen days to withdraw from the day the contract was concluded. That right does not end early: section 356(5) no. 2 German Civil Code applies to services, and renting out a parking space is a lease. You declare your withdrawal to the host; the name and address of a commercial host are stated in the listing and in your contract PDF (article 246d section 1 no. 4 of the Introductory Act to the German Civil Code).

Short-term parking by the hour or by the day

Because the parking time often starts immediately, you expressly confirm before booking that the brokerage and the parking time are to begin before the withdrawal period expires. The brokerage is fully performed with the booking confirmation, and your right of withdrawal for it ends at that moment (section 356(4) German Civil Code). If you withdraw from the lease with a commercial host, you pay a proportionate amount for the parking time used up to the withdrawal (section 357a(2) German Civil Code) and get the rest back. Independently of that, you can cancel free of charge until the booking starts.

Withdrawing from the rental agreement does not affect the brokerage by Sostivo, and vice versa. These are two contracts.

Part C, model withdrawal form

There are two versions, depending on what you want to withdraw from: the brokerage goes to Sostivo, the rental agreement goes to the host, never to the same address.

For renting a parking space from a commercial host

You address this form to your host, not to Sostivo. It cannot be pre-filled on this page because the page does not belong to any particular contract: the name and address of a commercial host are stated in their listing, and on your contract page this form is already addressed to them, as it is in the contract PDF.
